Event & General Photography:
While Eric Pargas Photography grants the client general personal use rights, including printing and sharing on social mediaI, acknowledge that the First amendment always applies and the photographer retains full ownership rights to all images captured, unless leased or specifically transfered legally with a contract.
General rules Regarding Shoots or Portrait sessions:
-Last minute outfit changes or double shoots snuck into one: example, (a couples shoots but last minute change into cap and gown for graduation photos) is a totally different shoot unless agreed upon before hand, and should be charged separate as a graduation shoot.
- Any last minute add ons outside the Sope of the shoot discussed before hand are possible to do last minute, but with an additional charge.
-Photographer/Videographer isn’t charged less by how efficient he is, such skill takes years of experience and knowledge and paid education or certifications. (if we all had free energy and electricity, we wouldn’t save energy, we would abuse this feature and keep house lights on 24-7, have lots of unessisary things on and sucking up energy, and unfortunately people tend to treat skilled workers and efficient artists this way which leads to burnout, and additional costs, time, and lower quality work)
Publishing and Commercial Use:
• The client must inform the photographer if any images will be submitted for publication, such as in magazines or news articles.
• The publication or entity must credit the photographer when using their photos in any editorial.
• If a photo is used for commercial purposes without the photographer’s prior consent, the photographer reserves the right to issue a cease-and-desist order or seek monetary damages as necessary.
I acknowledge that the photographer may request to use certain images for portfolio purposes, examples of work, or for promoting their business and marketing (commercial use).
Creative Clause:
I understand that I have engaged Eric Pargas Photography for their distinctive style and approach, and I accept the inherent creative risks, which may affect the final outcome. These include:
• The possibility of not capturing a specific shot due to lack of communication, which could lead to dissatisfaction.
• The client’s suggestions are welcome, but the photographer cannot be held responsible for ideas not communicated in advance or decided upon after the shoot.
• The photographer may cull or delete photos deemed duplicates, blurry, or unusable.
• Requests for additional work beyond what was initially agreed upon, including extra time, editing, or locations, may not be accommodated.
Event-Related Risks:
While rare, risks during significant events may include:
• Missing key shots due to equipment malfunction, challenging lighting conditions, or obstruction by people.
• The photographer’s inability to capture certain shots due to health and safety concerns or lack of access to optimal shooting locations.
• Potential accidents, such as the photographer accidentally knocking over a drink or bumping into objects while maneuvering large equipment in tight or crowded spaces.
Photo Editing:
Photo edits typically include:
• Adjusting highlights and shadows to preserve important details.
• Occasionally removing distractions like spots, hair, pimples, or shiny sweat spots.
• Cropping and straightening images to emphasize the main subject.
• Sharpening or reducing grain when necessary.
• Correcting skin tones and occasionally applying creative color grading or enhancements.
